This website is operated by CLICKCOACH. Throughout this Agreement we use the terms “we”, “us”, “our”, or the “Company” to refer to CLICKCOACH. If you are a parent or legal guardian of a user under the age of 18, by allowing your child to use the Service, you are subject to the terms of this Agreement and responsible for your child’s activity on the Service.
Our Website provides a platform for artists within the classical music, musical theater, and jazz communities to share valuable knowledge with the world in the form of accessible, insightful, and informative videos to a) support themselves or other artists financially, b) promote advancement in music education by offering a unique and rich aggregate resource of online instructional content, and c) provide resources to poor or underprivileged groups. CLICKCOACH also accepts donations through the CLICKCOACH Assistance Fund (CCAF), through which everyone can help the arts community.
The Website functionality allows artists to post instructional videos, which the users can purchase to stream an unlimited number of times during a thirty (30) day period. The majority of the proceeds from user purchases go to the artist who posted the instructional video or all proceeds going to the CCAF, depending on the artist’s election.
We reserve the right to withdraw or amend this Website, and any service or material we provide on the Website, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Website, or the entire Website, to users, including registered users.
You are responsible for:
- Making all arrangements necessary for you to have access to the Website.
If you choose, or are provided with, a user name, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity. - In any way that violates any applicable federal, state, local or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).

The types of Material that Users are authorized to access on the Site includes Material commissioned by the Company, embedded Material, Material we believe to be covered by the Fair Use Doctrine, Material from photographic archive and video vendors, instructional videos from artists, and Material supplied to our staff or released into the public domain by public relations and marketing companies for press purposes.
In accordance with the Digital Millennium Copyright Act (“DMCA”), we will remove any Content if properly notified that such Content infringes on your intellectual property rights. We reserve the right, at our sole discretion, to remove any Content without prior notice.

a) Terms of Sale
By placing an order with us, you are (i) offering to purchase the ability to stream an instructional video an unlimited amount of times during a thirty (30) day period, (ii) representing that you are 18 years or older and, thus, of legal age to form a binding contract, or, if you are under 18 years of age, that you have consent of a parent or guardian, and (iii) representing that all information you provide to us in connection with such order is true and accurate and you or your parent/guardian are an authorized user of the payment method provided. The receipt by you of an order confirmation does not constitute our acceptance of an order. We retain the right to refuse any order request made by you.
Prior to our acceptance of an order, verification of information may be required. We reserve the right at any time after receipt of your order to accept, modify or decline your order, or any portion thereof, even after your receipt of an order confirmation from us, for any reason whatsoever. We reserve the right to limit the number of videos ordered and to refuse services to you without prior notification. In the event that a video lists an incorrect price, either due to typographical or other error, we shall have the right to refuse or cancel any such order placed for the incorrect price, regardless of whether the order is being or has been processed. Our website accepts payment via credit and debit card (Visa, Mastercard, etc.) or by gift cards, which can be purchased on the Website. All payments by credit card or debit card need to be authorized by the relevant card issuer. Your credit or debit card will only be charged once you confirm your order. The purchased video(s) will not be available to stream until the payment has been processed. We will not issue refunds, except in limited circumstances determined solely by CLICKCOACH. If you have any issue or dispute with the Company, you agree to first contact us here and attempt to resolve the dispute with us informally. If we are not able to resolve the dispute with you informally, both parties agree to resolve any claim, dispute, or controversy (excluding claims for injunctive or other equitable relief) arising out of or in connection with or relating to these Terms by binding arbitration by the American Arbitration Association (“AAA”) under the Commercial Arbitration Rules and Supplementary Procedures for Consumer Related Disputes then in effect for the AAA, except as provided herein.
Unless both parties agree otherwise, the arbitration will be conducted in Comal County, Texas. Each party will be responsible for paying their respective AAA filing, administrative and arbitrator fees in accordance with AAA rules. The award rendered by the arbitrator shall include costs of arbitration, reasonable attorneys’ fees, and reasonable costs for expert and other witnesses, and any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Nothing in this Section shall prevent either party from seeking injunctive or other equitable relief from the courts for matters related to data security, intellectual property or unauthorized access to the Service.
ALL CLAIMS MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING, AND, UNLESS WE AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS. YOU AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND THE COMPANY ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.
